Who gets to stay in the house during the divorce?
This is often one of the biggest issues in a divorce, especially a divorce with children. Either spouse can stay in the house during the divorce, regardless of whose name it is in, as long as the home is owned. If the couple rents the home, then the person in whose name the lease is in would normally get to stay in the home. In either case, if the Parties cannot agree on who stays in the home, then the Court can issue an order granting temporary exclusive use of the marital home to one of the Parties. Whoever stays in the home is usually required to pay the mortgage/rent and the utilities.
